REMINDER TO ALL OWNERS: THE ANNUAL MEETING IS WEDNESDAY, June 27, 2018 at 7pm in the clubhouse. WE ENCOURAGE everyone and especially the many new owners who have recently arrived to join us. This meeting is important as we review all our projects and those in the “pipe line” along with a full discussion of the operating Budget regarding financial requirements moving forward.

Welcome to our favorite season of the year.

IRRIGATION is on from 1 am thru 5am. All zones do not operate every night; some run every other night and all are adjusted as weather dictates. Please DO NOT place garbage bags, recycle containers or boxes on the grass during the season. The irrigation heads are installed all along the curb lines. Please contact Jen @ Palmer to reportany broken heads. Please do not use the plastic garbage bags; they are an open invitation to the raccoons & Waste Management will not clean up after broken bags.

MULCH has been installed. We have converted to the natural organic product and will no longer use the black dyed material.

DOCUMENTS are or will shortly be posted on the SVTA web site. The official Maintenance Standards are posted and a copy will be provided to all residents. The new Declaration and Bylaws are ready. They will be reviewed briefly at our Annual Meeting but a future monthly meeting will be dedicated for a discussion. You will receive an email notice when they have been installed on the site.

DOOR & PAINTING projects will be reviewed at the Annual Meeting and details will be provided in another newsletter.

TREE REPLACEMENT requirements will also be addressed at the Annual Meeting with other projects.

PARKING STICKERS are being replenished and will be distributed to those who have notified Jen @ Palmer. Parking rules are in effect from sundown as it applies to overnight parking requirements. Units with one vehicle must park in the garage or driveway. Units with multiple vehicles may park only one in an available space. Vehicles must be removed during the day so everyone has an opportunity to locate an overnight space. No storing of vehicles in the same space.

GARAGE DOORS have been inspected as part of their spring walk thru by Property Management and will notify those that need replacement.

REC CORP GRILL INSTRUCTIONS. Each burner operates independently (once one is lit it will not jump to another) When first starting each burner must be primed. Push the knob and turn slightly to the left before the “click” and wait about 10 seconds to allow the venturi to fill with gas. Then turn past the click to light. Initially this may have to be done 2 or 3 times after the burners have been turned off; It is not necessary to light all burners to cook a couple of burgers. All burners lit will quickly raise the temp to 600 degrees. The second knob from the right side of each grill has a sign “do not use”. That knob is for a rotisserie that is not part of this equipment. Do Not Light it.

DOGS…once again; SVTA is NOT a Condo…we own our individual lots. All lots are private property. No dog is permitted to walk along let alone enter any lot except your own and you must immediately pick up after your pet. Milford Landscaping has complained that their workers on riding as well as hand operated mowers are experiencing very unpleasant experiences when cutting lawns here. This has also occurred along the stone wall on Merwin Ave. and the REC CORP Property across Merwin is a No Dog venue. Dogs are permitted in SVTA ONLY with the APPROVAL of the Board or Property Manager. Unfortunately if the residents that continue to cause this issue do not correct this behavior; the Board will enforce the remedy.

The Ratifrcation of the Budget for fiscal2018-2019 and theadoption of the amended Declaration & By Laws will be at theSuriVillage annual meeting to be scheduled in June.

PROJECTS for Spring into late Fall this year ate in the planningstage and will be presented in more detail atthe Annual Meeting.

Looks like Springs is finally emerging from the shadows of Winter; Time to remind all our residents and revisit some of theresponsibilities and cooperation that's required to respect ourproperties and enjoy the unique lifestyle of this special beachside Community.

Now that the weather is breaking, our beautiful trees are in budand Milford Land is starting the annual spring clean up to erasewinters last stand we ask all residents to look around their unitand remove any items stored under porches & decks (shouldn'tbe anything thire) and put out their flowers and pots. Mulch willbe installed at the entrances and the front landscape areas on all units

Garbage and recycles must be secured in their containers andnot put out in plastic bags for the raccoons to distribute onTuesday evening and always returned into the gatage Wednesday as soon after collection as possible.

To restate the pet rules; agarn. Dogs must be on leash at all timeswhen being walked outside the unit but never left alone & tiedup. Dogs are to be contained within the boundaries of your lot and you must immediately pick up after them and disposeproperly indoors. NO DOG may be walked around thecommunity and allowed to enter on anyone' s property or on coflrmon areas around mail boxes, street lights and the grassystrip along the stone wall on Merwin Ave or across the street onREC CORP property for any reason. Each lot, in front and backand to the side is the property of that resident and dogs are notallowed to go onto the lots. The ONLY area designated as a "dogwalk" is on the Fire Road on the far side of the creek and youmust pick up and NOT dispose until you return home. Residentswho use dog walkers must be inform them and to adhere to these requirements.

The limited parking spaces available (we have 162 tegisteredvehicles and 42 street parking spots) will come under heavy use especially over weekends during the summer season. The Parking rules are: Units with only l(one) vehicle are requestedto parkit in your garage or driveway. Units with multiple vehicles may park 1 (one & only one) in an available space overnight and must have the parking decal visible on the rear ofthe vehicle. New residents and those with a new vehicle that donot have a decal must contact Jenifer at Palmer Property toregister and obtain a decal. Vehicles without a decal parkedovernight are subject to being towed. NO VEHICLE may parkat any time day or night on any of the streets in Surf Village. Allstreets are actually FIRE LANES and are so posted. There is aNO TOLERENCE policy for cars left on the street. The onlylimited exception is the allowance for a cleaning person,contractor or delivery vehicle to park a few minutes on the streetlong enough to unload equipment, furniture, appliances INTO the DRIVEWAY and not then deliver into the home but must then remove the vehicle to a parking spot.

The replacement of external lighting (i.e .-burned out bulbs) isthe responsibility of the resident owner or tenant. This isimporlant as a deterrent due to the recently reported break ins in Milford. This is especially critical on Merwin Ave. as theforward face of Surf Village and on the back side of the Seahawk Court decks that is not well illuminated. Please check your unit after dark to replace bulbs.

Garage doors along with all windows, skylights, sliders andstorm doors are aunit owner responsibility. The PropertyManager on a recent inspection has noted that sevetal gatage doors are in poor condition and in some cases have de-laminated and need to be replaced. Garage doors are not painted by the Association. Palmer Property will be notiffing those Unit Owners that require replacement. Re: The process of voting to adopt revisions and updates to Town House Documents

The Association recently circulated a ballot form to Owners for the purpose of conducting a vote on adoptions of Amendments updating the Town House Community Documents.

The Board received a strongly worded correspondence from an owner expressing the opinion that (i) the 1983 Surf Village Declaration and Bylaws requires that a vote to amend them may only be taken at a meeting of the owners, (ii) a vote taken by ballot without a meeting would be null and void, and (iii) proceeding without a vote is somehow fraudulent and that the Board knew that they were violating their obligations.  It is apparent these opinions have been shared with some members in the Community.

In 2016 the Board engaged a noted expert in the law of community associations to advise them on the process of updating the Community Documents. The Attorney was selected in part because he served as a member of the Committee that developed the legislation that updated the Connecticut Common Interest Ownership Act in 2009 (“CIOA”). The Association’s Attorney strongly disagrees with the claims stated above.  He has advised the Board that the sections of the current Town House Declarations and Bylaws which make reference to a vote being taken “at any meeting” do not require a vote be taken ONLY at a meeting to the exclusion of the other means of action provided in applicable Connecticut law. The other voting methods permitted include voting by proxy or by paper or electronic ballot when a vote is conducted without a meeting.

The Board has acted in good faith and in reliance on the opinion and guidance of its Counsel.

Board Members have been advised that conducting the vote by ballot without a meeting is in compliance with the requirements of applicable Connecticut law and the Surf Village Documents.  The Association Counsel expressed his opinion that this ballot procedure would withstand a court challenge, should one be brought.

The matter of updating our documents is more important than a disagreement over the manner in which the vote is cast. The Board has elected on advice of Counsel, to provide a new ballot that includes a proxy to allow an Owner to vote at a meeting in person or by proxy. (This new ballot will be mailed separately from this notice) Approximately 20 of the SVTH Owners do not reside in the Community and many refrain from attending meetings because of the confrontations that often result.

The Annual Meeting is Wednesday, June 26th at the Club House at 7:00 PM. The Board has asked Attorney Ed Hill to be available at the meeting to answer questions from Owners; and he will be available either by video conference or skype. We encourage all Owners to attend this meeting.
